Duty to exercise due care in the use of genetic resources. Beneficiaries of funding for research related to the exploitation of genetic resources and traditional knowledge related to genetic resources must declare that they have exercised due diligence in accordance with Article 4 of the Regulation. At the stage of final development of the product developed through the use of genetic resources or traditional knowledge related to genetic resources, users shall make a declaration to the competent authorities referred to in Article 6(1) that they have complied with the obligations under Article 4 and shall also provide: (a) the relevant information from an internationally recognised certificate of compliance; or (b) the relevant information referred to in Article 4(3)(b)(i) to (v) and Article 4(5), including, where appropriate, information on the negotiation of mutually agreed terms and conditions. Users shall provide additional evidence to the competent authority upon request.
