If an exporter is to export a chemical substance from the Union to a Contracting Party or to another country for the first time since the date on which the substance became subject to this Regulation, he shall notify the designated national authority of the Member State (Ministry of the Environment) in which he is established at least 35 days before the expected date of export. During the first quarter of each year, each exporter shall inform the designated national authority of the Member State of export (the Ministry of the Environment) of the quantity of the chemical (as such or contained in mixtures or articles) that it has shipped to any Party or other country during the previous year. (1) The provisions for packaging and labelling set out or referred to in Regulation (EC) No 1107/2009, Directive 98/8/EC and Regulation (EC) No 1272/2008 or any other relevant Union legislation shall apply to chemicals intended for export. The first subparagraph shall apply unless those provisions conflict with specific requirements of the importing Party or other country. 2. Where appropriate, the expiry date and the date of manufacture of chemicals listed in paragraph 1 or in Annex I shall be indicated on the label and, where applicable, the expiry date for different climatic regions shall be indicated. 3. The safety data sheet pursuant to Regulation (EC) No 1907/2006 of the European Parliament and of the Council shall be attached when the chemicals referred to in paragraph 1 are exported. The exporter shall send the safety data sheet to any natural or legal person importing the chemical substance into a Party or other country. 4. Exporters of chemicals subject to the obligations set out in Article 8(2) and (4) (export notifications to Parties and other countries) shall include the relevant reference identification numbers in their export declarations. Exporters of chemicals exempted pursuant to Article 8(5) from the obligations set out in paragraphs 2 and 4 of that Article or chemicals for which that obligation has ceased to apply in accordance with Article 8(6) shall obtain a specific reference identification number through the database and include that number in their export declaration.
