Obligation for an investor from a non-EU country to submit an application for a foreign investment permit to the Ministry of Industry and Trade if it intends to invest in sectors most sensitive from the point of view of security or internal or public order (i.e. critical infrastructure, critical information infrastructure, military material, dual-use goods). Obligation for a non-EU investor to submit a request for consultation if it is a significant foreign investment in the media sector (i.e. broadcasting, publishing of periodicals). Obligation of the non-EU investor to provide the required information (e.g. source of financing and amount of the foreign investment, information on the ownership structure of the investor and the target company) in the application for a foreign investment permit, in the proposal for consultation and after the initiation of the procedure for ex officio examination of the foreign investment. Note: The obligations apply only to persons who are foreign investors within the meaning of Act No. 34/2021 Coll., not to Czech entities to which the investment is directed. Ex officio proceedings are initiated by the Ministry of Industry and Trade only for foreign investments that may have an impact on the security of the Czech Republic or internal or public order.
