In order to protect the health and safety of consumers, the manufacturer is obliged to carry out tests of product samples and other necessary investigations concerning the products placed on the market, to keep a record of complaints and non-compliant products and products which he has withdrawn from circulation, and to inform the distributors to whom he has supplied these products of these facts (in the cases and to the extent provided for by the relevant government regulation).

If the product poses a risk to life, health, property or the environment, or other public interest, the manufacturer is obliged to immediately inform the supervisory authority (the Czech Trade Inspection Authority, or another administrative authority if another law so provides) or the competent authorities of another Member State of the European Union in which the product was placed on the market about the risk and its nature and causes, as well as about the measures taken or the withdrawal of the product from circulation or the market.

The manufacturer is obliged to provide the supervisory authority (the Czech Trade Inspection Authority, or another administrative authority if another law so provides) or the competent authority of another Member State of the European Union in which the product is placed on the market with the information and documents necessary to prove the conformity of the product upon its reasoned request. Unless they agree otherwise, it shall provide such information and supporting documents in the official language of the relevant Member State of the European Union. The manufacturer shall provide those authorities with the assistance necessary to enable them to exercise their powers with a view to eliminating the risks arising from products which he has placed on the market.

The authorised representative shall carry out the tasks within the scope of his mandate and shall keep the declaration of conformity and the technical documentation for the period specified in the Government Regulation. Upon request, he/she shall provide the supervisory authorities (the Czech Trade Inspection Authority, or another administrative authority if another law so stipulates) with the information and documentation necessary to prove the conformity of the product and the cooperation necessary to exercise their competence in order to eliminate the risks caused by the products to which his/her mandate applies.

Where the product presents a risk, the importer who intends to place the product on the market shall immediately inform the manufacturer thereof and shall also inform the supervisory authority, including information on the nature of the risk and its causes, as well as on the measures taken by the importer or on the withdrawal of the product from the market or from circulation.
