Proving the supplier's qualifications. In above-limit public contracts, suppliers are required to demonstrate basic and professional competence. If required by the contracting authority, they shall also demonstrate economic and technical qualifications.

The contracting authority shall send the selected supplier a request to submit additional documents, e.g. documents on its qualifications required by the contracting authority and not available, documents or samples whose submission is a condition for the conclusion of the contract.

The supplier may demonstrate the economic qualification, technical qualification or professional competence required by the contracting authority through other persons. In such a case, the Supplier is obliged to submit to the Contracting Authority the documents and documents prescribed by Act No. 134/2016 Coll., on public procurement, as amended.

The contracting authority may require the selected supplier to submit documents or samples related to the subject of the public contract or the supplier's qualifications, successful results of sample tests, submission of a document proving the supplier's ability to protect classified information, if this is necessary for the performance of the public contract.

Submission of documents for inclusion in the list of qualified suppliers maintained by the Ministry for Regional Development. Entry in the list of qualified suppliers is made on the basis of a supplier's application. The application must contain the originals or certified copies of the documents proving basic competence and professional competence. If a supplier's data entered in the list of qualified suppliers change, the supplier must submit an application for entry of the change in those data within 15 working days of the date of the change. A supplier registered in the list of qualified suppliers shall deliver to the Ministry of Regional Development by 31 March of each year following its registration (a) a written declaration that there has been no change in the registered data, and (b) documents proving the basic competence.
