Each entity that handles hazardous chemicals must establish a list of these substances, listed in Tables I and II in Annex 1 to this Act, and follow the procedures set out in this Act.

Any entity that handles hazardous chemicals listed in the tables to Annex 1 to this Act must declare their quantities, compare them with the limit quantities listed in this Annex and proceed in accordance with this Act.

The operator (i.e. a legal or entrepreneurial natural person who uses or will use a facility in which a hazardous substance is or will be located according to Annex 1 to Act No. 224/2015 Coll.), who will establish a new facility, a part thereof or will change the use of a building, is obliged to prepare a proposal for classification and submit it to the regional authority.

The operator of a facility classified as Group A or Group B (depending on the quantity of hazardous substance present in the facility) shall carry out a major accident risk assessment for the purpose of preparing a safety programme or safety report. This assessment shall include: identification of sources of risk, risk analysis, risk assessment and evaluation of the impact of the accidental manifestations.

The operator of a Group A facility shall prepare a safety programme based on a major accident risk assessment. The content of the safety programme is specified in Decree No 227/2015 Coll., on the details of the safety documentation and the scope of information to be provided to the preparer of the assessment. The operator shall submit the draft safety programme for approval to the regional authority within 6 months from the date of entry into force of the regional authority's decision on the classification of the facility in Group A.
