Obligation to obtain authorisation for the contained use of genetically modified organisms on the basis of a notification of contained use or a permit. The notification of the contained use of GMOs shall be submitted by the notifier to the Ministry of the Environment. Further conditions for the authorisation are laid down in Section 16.

Obligation to obtain a permit for the introduction of genetically modified organisms into the environment. Further conditions for the establishment of this authorisation are laid down in § 17 and § 18.

Obligation of an applicant for a marketing authorisation or entry on the List to attend a public hearing on the application. In addition to the Ministry of the Environment, the applicant for a marketing authorisation or entry on the Marketing List shall always attend the public hearing. In the absence of the applicant, the Ministry of the Environment may terminate the public hearing and set the place and time of a new public hearing at the applicant's expense. The new public hearing shall be held no later than 5 days from the date of closure of the public hearing. The Ministry of the Environment shall inform the applicant of the place and time of the new public hearing.

Obligation of the applicant to submit to the Ministry of the Environment a risk assessment of the handling of genetically modified organisms and genetic products as part of the application for the granting of a permit and the application for entry into the List for marketing.

Identification and justification of the information to be treated as confidential. The applicant or notifier may, at the same time as submitting the application or notification, request the Ministry of the Environment to treat certain information contained in the application or notification as confidential. The information to be treated as confidential must be identified in the application or notification.
