A person who places packaging or a packaging device on the market is obliged, upon request, to provide the inspection authorities with the technical documentation necessary to demonstrate compliance with the obligations set out in Sections 3 and 4 of the Act (e.g. the obligation to ensure that the weight and volume of the packaging is as small as possible while complying with the requirements imposed on the packaged product and while maintaining its acceptability to the consumer or other end user, with a view to reducing packaging waste).

A person who places packaging or packaging material on the market is obliged to inform its customers that the packaging or packaging material complies with the requirements set out in Sections 3 and 4 of the Act (e.g. the obligation to ensure that the packaging or packaging material, after the use for which it was intended, after removal of the product or all its residues in the usual way, is further reusable or recoverable through recycling, energy recovery or biodegradation).

Persons placing on the market single-use plastic beverage bottles of up to 3 litres, including their caps and lids, fulfilling their obligations both individually and through an authorised packaging company (AOS), must keep records in relation to the reporting of the mandatory recycled content of single-use plastic packaging and report the amount of recycled plastic they have used in such packaging. Reporting is done through the Integrated Reporting Obligations Compliance System (IRCS) or the Ministry of the Environment's data box for environmental reporting.

A person who places packaging or packaged products on the market or in circulation is obliged to submit to the Ministry of the Environment, within 60 days of the obligation arising, a proposal for entry into the List of persons who are carriers of the obligation to take back and recover packaging waste, and is obliged to notify the Ministry of the Environment of any changes to the data within 14 days of their implementation and the termination of the legal grounds for its inclusion in the List.

A person subject to the obligation to register in the List of Persons is obliged to keep a continuous record of packaging and packaging waste and the methods of their management, and to report the data from this record for the previous calendar year no later than 15 March 2012. February of the following year to the Ministry of the Environment through the integrated system for the fulfilment of reporting obligations in the field of the environment or the data box of the Ministry of the Environment designated for the fulfilment of reporting obligations in the field of the environment, to prove the truthfulness of the data kept and reported upon request of the Ministry of the Environment or the Czech Environmental Inspectorate, to keep documents with the data kept in this register and reported from this register for at least 5 years.
