The holder of the plant variety right shall ensure that the protected variety is maintained throughout the term of the protection rights so that the characteristics which define it remain unchanged. The maintenance of the protected variety shall be checked by the Central Institute for Agricultural Inspection and Testing (hereinafter referred to as 'the Institute') by means of verification tests. The holder of the plant breeding right shall be obliged to provide the Institute, on request, within a reasonable time limit set by the Institute, with all the information necessary to assess the continued existence of the protected variety.

A processor who intends to carry out the treatment of propagating material of protected varieties in accordance with Section 19a(2)(b) (i.e. the grower may treat the farm seed or seedlings for further sowing and planting either himself or through a person who treats such material on a business basis (the processor); the processor must carry out the treatment in such a way as to ensure that the product to be treated is identical to the product resulting from the treatment) must notify the Central Inspection and Testing Institute for Agriculture in writing before commencing the treatment.
