If the corrective measures do not allow compliance with the indicators with the highest limit value, with the exception of microbiological indicators, the persons referred to in Section 3(2) (e.g. the operator of a water supply system for public use) may apply to the competent Public Health Protection Authority (hereinafter referred to as the "PPA") for the establishment of a lower hygiene limit than that laid down in the implementing legislation. Before the expiry of the period for which the less stringent hygiene limit has been limited pursuant to paragraph 1, the person referred to in paragraph 1 shall be obliged to provide evidence to the competent PHSO as to whether and to what extent remedial action has been taken.

Competent persons (e.g. the operator of a water supply system for public use, the operator of a public well serving as a source of drinking water) are obliged to draw up an operating order and submit a draft for approval to the competent Public Health Protection Authority (hereinafter referred to as the "PPA"). They are also obliged to review and update the operating order on an ongoing basis and to submit draft amendments for approval to the competent PPA whenever the operating conditions change; if there is no change to the operating order, they are obliged to submit the operating order for approval to the competent PPA at least once every 6 years.

The persons referred to in § 3(2) (e.g. the operator of a water supply system for public use), with the exception of the persons referred to in § 3(2)(a) and (b), are obliged to ensure that up-to-date information on: a) the quality of the drinking water supplied and the chemical substances and chemical mixtures used to treat that water, b) whether a risk assessment and risk management pursuant to § 3c(2)(a) and (b) has been carried out, is publicly available on their website or in a manner customary in the locality. (c) whether unacceptable risks have been identified and appropriate corrective measures taken as part of the risk assessment and management pursuant to Section 3c(1)(f).

At the request of a person (operator or owner of a water supply), the competent public health authority may authorise the use for a limited period of time of water that does not meet the limit values for drinking water indicators, with the exception of microbiological indicators. The public health authority shall grant a permit if the drinking water supply cannot be otherwise ensured and public health is not endangered (corrective measures are sufficient to remedy the defect within 30 days and the non-compliance with the hygiene limit of any indicator with the highest limit value has not lasted more than 30 days during the last 12 months).

Persons operating priority premises, e.g. health care facilities where inpatient care is provided, are required to prepare a risk assessment and management of the internal water supply and connection and to submit draft operating rules for approval by the relevant public health authority.
